General Terms and Conditions CulturInvest! Congress

1. Scope

The following General Terms and Conditions of Business shall govern the contractual relationship between the participants in the two-day congress (CultureInvest! Congress) organised by the agency Causales (hereinafter: The Organiser), which will take place on 7 and 8 November 2019 at the Zollverein UNESCO World Heritage Site in Essen) and the Organiser. Differing general terms and conditions of the participant have no validity.

2. Registration/ Confirmation of Registration

You can register via Internet, letter, telefax or e-mail. Upon receipt of the application, a legally valid contract is created. In the course of the registration the Organiser publishes the names of the participants in the Internet (not your personal e-mail address!) in the sense of an optimal networking on site. Participants who do not wish to make use of this service must inform the Organiser accordingly.

3. Services

The participation fee is per person plus VAT (MwSt.) for participants from Germany. For participants who do not come from Germany, the value-added tax does not apply upon indication of the UID/VAT. The amount includes the congress attendance, congress documents and all-day catering. The Organiser assumes no liability for any programme modifications, speaker cancellations or printing errors. If the event cannot be held due to force Majeure or for other important reasons (e.g. illness of the speakers or insufficient number of participants), the participants will be notified immediately. The event fee will be refunded in this case. A claim for reimbursement of travel and accommodation expenses as well as loss of working hours shall be excluded.

4. Due date, Payment, Default and Set-off

The confirmation of the registration is sent to the participants in the form of an invoice and must be paid within 10 days of receipt. If the participant is in default of payment, the Organiser reserves the right to charge a reminder fee of € 5.00.

5. Cancellation

In case of cancellation (only in written form) up to one calendar week before the start of the congress, a cancellation fee of 50% of the congress fee will be charged, after that the total amount of the participants will be due in full. If a replacement participant is named in good time, the cancellation fee shall not apply.
If the event has to be canceled due to force majeure, the ticket costs will be reimbursed in full.

6. Copyright

The congress documents are protected by copyright. The duplication, passing on or other use of the conference documents is only permitted with the express written consent of the Organiser.

7. Liability

Lectures at events are carefully prepared and delivered by qualified authors and speakers. The Organiser assumes no liability for the topicality, accuracy and completeness of the event documents and the performance of the event.

8. Place of Jurisdiction

This agreement shall be governed by German law. Place of jurisdiction is Berlin/Germany.

9. Data Protection

The Organiser protects personal data. The Organiser will treat the data provided by the participant confidentially and use them only in accordance with the data protection guidelines. Personal data constitute all data that is stored in connection with your name.


General Terms and Conditions European Cultural Brand Award

1. Scope

The following General Terms and Conditions of Business shall govern the contractual relationship between the participants in the Cultural Brand Award and the agency Causales (hereinafter: The Organiser). The award ceremony and gala will take place on 7 November 2019 inEssen. Differing general terms and conditions of the participant have no validity.

2. Application / Application Deadline

You can apply by letter, telefax or e-mail until 31 August 2019. Upon receipt of the application, a legally valid registration for participation in the competition is created. The list of applicants and nominees will be published on the Internet (without contact details). Applicants who do not wish to be published must inform the Organisers accordingly.

3. Services

The processing fee is per category plus VAT (MwSt.) for participants fromGermany. For participants who do not come fromGermany, the value-added tax does not apply upon indication of the UID/VAT. The Organiser accepts no liability for changes to the Gala programme. An application does not imply any right to an oral or written evaluation of the submission by the Jury or the Organiser. If the award ceremony cannot be held due to force Majeure or for other important reasons (e.g. insufficient number of applicants), the applicants will be informed immediately. The application fee will be refunded in this case. A claim for reimbursement of travel and accommodation expenses as well as loss of working hours shall be excluded.

It is not possible to cancel the application or the proposal in the category "European Cultural Manager of the Year".

Submitted application documents will be treated confidentially and shall not be passed on to third parties.

7. Liability

A refund of the charges will be guaranteed if the award ceremony cannot take place due to insufficient participation. If the performance of the event is endangered by force Majeure, no costs will be reimbursed.

8. Place of Jurisdiction

This agreement shall be governed by German law. Place of jurisdiction is Berlin/Germany.

9. Data Protection

The Organiser protects personal data. Causales will treat the data provided by the participant confidentially and use them only in accordance with the data protection guidelines. Personal data is all data that is stored in connection with your name.


General Terms and Conditions Booking of Advertisements

1. Scope

The following General Terms and Conditions of Business shall govern the contractual relationship between the Client and the agency Causales (hereinafter referred to as the Publisher)

2. Booking of Advertisements

Your advertisement booking on the business portal www.kulturmarken.de,  in the Jahrbuch Kulturmarken and in the Annual of Cultural Brands can be effected via Internet, letter, fax or e-mail. With the receipt of the advertisement booking a legally valid contract is created. The Publisher reserves the right to reject advertisement bookings due to their content, origin or technical form according to the Publisher's uniform principles if their content violates laws or official regulations or if their publication is unreasonable for the Publisher. The refusal of an order will be communicated to the client without delay.

3. Advertisement Creation

The design of an editorial advertisement in the above-mentioned media is carried out by the Publisher or his service provider. The Client will receive a briefing from the Publisher for the compilation of the required data and information. The Client shall send the Publisher texts, printable photos and logos adapted to the booked page size for the editorial advertisement until the copy deadline. The Client is obliged to provide exclusively such data which he himself has written or commissioned from a third party. The Client shall provide the Publisher with the relevant copyright information insofar as the Client is obliged to have it reproduced. The Client shall be responsible for the timely delivery of the advertisement text and faultless print documents. The Publisher shall send the Client the designed advertisement in digital form for printing approval. The Client has the option of carrying out a correction process if there are textual or design deficiencies. The Publisher subsequently returns the advertisement to the Client again for printing approval. The printing approval must be given in writing (by e-mail, fax or letter) to the Publisher. No corrections can be made after the print approval has been given. The Publisher shall immediately request a replacement for obviously unsuitable or damaged printing documents. The Publisher guarantees a standard printing quality within the limits of the capabilities provided by the printing documents.

4. Claim for Payment Reduction or Replacement of Advertisement

If the advertisement is printed illegibly, incorrectly or incompletely in whole or in part, the Client shall be entitled to a reduction in payment or a faultless replacement of the advertisement in the subsequent publication to the extent that the purpose of the advertisement had been impaired. If the Publisher fails to meet a reasonable period of grace set for this purpose or if the replacement advertisement is again defective, the Client shall have the right to withdraw from the contract.

Claims for damages due to culpa in contrahendo, positive breach of contract and/or tort are excluded unless the bodies or vicarious agents of the publisher are guilty of wilful intent or gross negligence. Claims for damages due to inability to perform or delay are not excluded insofar as the inability to perform or the delay of bodies or vicarious agents of the Publisher are responsible; the liability of the Publisher in these cases is limited to compensation for the foreseeable damage, but at most to the fee to be paid for the advertisement, insofar as liability was not excluded on the basis of the Terms and Conditions. Complaints can only be asserted within four weeks of publication of the advertisement, unless they are hidden defects.

5. Cancellation

A cancellation free of charge (only in writing) is possible up to 14 days after the advertisement booking. Upon expiry of the 14-day period, a cancellation fee of 50% of the advertising costs shall become due.

6. Copyright

The publications Jahrbuch Kulturmarken and Annual of Cultural Brands are protected by copyright. The reproduction, transmission or other use is only permitted with the express written consent of the Publisher. Excluded from this is the advertisement booked by the Client, which the Client may use for his own purposes.

7. Method of Payment

The invoice will be issued after the order has been placed. Payment is due within 10 days of receipt, unless a different payment period has been agreed in individual cases. In the event of default or deferment of payment, interest shall be charged at a rate of at least 3 % above the discount rate of the Deutsche Bundesbank valid at the time as well as the collection costs. In the event of default in payment, the Publisher may postpone the further execution of the current order until payment has been made.

8. Liability

In the event of force Majeure, any obligation on the part of the Publisher to fulfil orders and pay compensation shall become null and void. In particular, no compensation shall be paid for advertisements not published in good time. In the event of operational disruptions or interventions due to force Majeure, e.g. strike, confiscation or similar, the Publisher shall be entitled to full payment of the published advertisements if the orders are fulfilled at 80% of the guaranteed print volume.

9. Place of Jurisdiction

This agreement shall be governed by German law. Place of jurisdiction is Berlin/Germany.
